Customer Terms and Conditions
The following Terms and Conditions must be read before registering as a customer of eMVee Talent Trackers. When you place an order you will have read and agreed to these Terms and Conditions, and you will not be able to proceed with an order if you are not registered and you do not agree to these Terms and Conditions.
Registration
To use the services and features of the eMVee website you will need to register. Customers must provide accurate and true information. Customers must provide their email address, their real name and or company name, current phone number and any other requested information. These details must be current, valid and correct.
emveett.com is only available to eCustomers who meet our Terms of Eligibility, i.e. those individuals who provide accurate information, who have been issued with a valid credit card, and who have authorised eMVee Talent Trackers to process a charge or charges to their credit card in the amount of the total purchase price for merchandise they have purchased from the eMVee website. Purchases made and Information obtained from the eMVee website must be for personal use only and cannot be resold, replicated or used for commercial benefit.
eMVee as Agent
eMVee Talent Trackers Pty Ltd ('eMVee') acts as the agent for each manufacturer of the Goods that are advertised and displayed for sale on the eMVee website. eMVee has authority to sell the Goods on these Terms and Conditions. The Customer acknowledges and agrees that any contract formed under these Terms and Conditions is entered into by eMVee in that agency capacity.
Contract
These Terms and Conditions apply to any contract for the sale of a product ("the Goods") by eMVee to a Customer ("the Customer"). eMVee and the Customer are referred to together as "the Parties". The contract will consist of the order, eMVee's confirmation of the order and these Terms and Conditions. If the Customer wishes to change any matter or information that was stated in the order or which is set out in eMVee's confirmation of the order, the Customer must contact eMVee by email as soon as possible after receiving the confirmation. The Customer acknowledges that this will be a variation of the contract which will require the agreement of eMVee, in circumstances where eMVee may already have begun to process the order.
Orders
The advertising or display of information relating to any Goods on the eMVee website is not an offer for sale but an invitation to a prospective Customer to offer to buy those Goods. eMVee reserves the right to decline orders for multiple quantities to one customer or address. The placing of an order is treated as an offer to buy the Goods stated in the order. The Parties do not enter into a contract until eMVee accepts an order. Acceptance will occur when eMVee sends an automated confirmation to the Customer through this website by email, at the moment when that confirmation is sent to the Customer.
Description of the Goods
The main characteristics of the Goods are stated on the eMVee website. For the purposes of the contract, the Goods will be identified in the order and the description will be taken to include the main characteristics stated on the eMVee website.
Any representation, description or warranty about the materials or processes used in the manufacture of the goods, the quality of those materials, and the originality of the work that is stated on the eMVee website is a representation, description or warranty that is made by the manufacturer and not by eMVee. eMVee makes every effort to display, photograph and describe the Goods as accurately as possible, but cannot guarantee that the Customer's computer monitor will display colour accurately.
Availability of the Goods
All Goods advertised on the eMVee website are subject to availability. If, for any reason eMVee is not able to supply the Goods specified in the order because the Goods are no longer available to eMVee, the Customer will not be charged for the Goods and eMVee will refund any payment of the Contract Price already made by the Customer. In those circumstances eMVee will not be liable to make any other payment to the Customer.
Contract Price
Prices on the eMVee website or in any advertising material published by eMVee are stated in Australian dollars, and may be altered by eMVee from time to time, in particular to take account of any increase in eMVee's costs in obtaining the Goods from the manufacturer or any increase in eMVee's operating costs. The "Contract Price", will be the price of the Goods as stated on the eMVee website at the time when the Customer places the order, plus eMVee's shipping charge for postage, packing and delivery by means of the appropriate mail service depending on the location of the address for delivery. The Contract Price is stated inclusive of Australian goods and services tax at the rate applying at the time.
If the price or shipping charge stated in the order or in the confirmation of the order is not as stated on the website at the time of placing the order, it will not be binding on the Parties and eMVee will contact the Customer to give the Customer the choice of correcting the mistake or not proceeding with the order.
eMVee takes all reasonable action to ensure that prices stated on the website are accurate. However, having regard to the volume and variety of items listed on the eMVee website, it is possible that a mistake may occur in the statement of the price from time to time. If a mistake occurs, eMVee will be under no obligation to fulfil the order at that price. eMVee will inform the Customer of the mistake as soon as possible and the Customer will have the option of confirming the order at the correct price or cancelling the order. In the event of such cancellation, eMVee will refund any payment made by the Customer promptly in full.
Payment & Payment Security
The Customer must pay the Contract Price in full and in cleared funds before the Goods will be shipped to the Customer. eMVee will be entitled to full payment for the Goods that are ordered, even though ownership in the Goods has not passed to the Customer.
Payments can be made on the eMVee website via PayPal according to their Terms and Conditions or by Direct Deposit . Payment will be cleared from the Customer's account at the time of their order. The Customer's credit card will be subject to validation checks and authorisation by PayPal. eMVee reserves the right to cancel orders and refuse supply if PayPal declines to authorise the payment.
The eMVee website has taken every precaution to make the site a secure one, however eMVee is not responsible to the Customer for any unlawful use of information furnished by a Customer in placing an order, making a payment and making a purchase.
Shipping
Goods are shipped to the Customer directly from Australia so, where applicable, the Customer will be responsible for payment of any import duties or taxes.
eMVee will notify the Customer when the Goods are ready to be dispatched. eMVee will ensure that they are packed safely and securely to protect them in transit and that they are marked in a proper manner and in accordance with any legal requirements and any requirements of the carrier.
Goods will be delivered by courier/ registered post or such other means of appropriate mail service depending on the location of the address for delivery. When eMVee dispatches your order an email will be sent with a registered number from the chosen delivery service. A signature will be required for any Goods delivered. Customers can check the status of their shipment by logging onto the nominated courier service website, using the registered number issued by eMVee to track orders. Orders will be shipped within 7 days of receipt of order.
Delivery will be taken to have occurred when the Goods are delivered to the address stated by the Customer in the order.
Ownership and Risk
All risk as to loss of or damage to the Goods will pass to the Customer on delivery to the address stated in the order. Legal ownership of the Goods will pass to the Customer immediately before we dispatch the Goods provided that eMVee has received payment of the Contract Price in full in cleared funds and no other payments are outstanding from the Customer in respect of any other Goods.
Returns Refunds & Exchanges
Customers can make a return, for a refund, eMVee credit or exchange on online purchases, if they are returned in the condition in which they were sold.
To exercise this right the eCustomer must request a Returns Authorisation number from eMVee returns@emveett.com within 7 days of receipt of the Goods. Returns will not be accepted without a Returns Authorisation number.
On receipt of the Returns Authorisation number the Customer will be under a duty to take reasonable care of the Goods, and to return them to eMVee at the Customer's expense within 7 days of receipt of the Returns Authorisation number. The Customer must return goods via a secure and insured delivery service as instructed by Returns at eMVee Customer Service. In returning the Goods, any loss of or damage to the Goods will be at the Customer's risk until they are received by eMVee. eMVee will not be required to refund the return delivery costs paid by the Customer.
Earrings must be returned unworn and in a resaleable condition and all Goods must be returned with packaging and designer tags attached to the item/s. If the Goods are faulty eMVee will refund postage, however eMVee cannot accept any liability for an item until it has been returned and confirmed as a faulty Good.
eMVee will examine the Goods as soon as reasonably practicable after they have been returned by the Customer. Provided that the Goods are complete and have not been used or damaged between delivery and their return by the Customer, eMVee will promptly refund the whole of the Contract Price to the Customer, including the original delivery charge.
If the Goods have been used or damaged between delivery to the Customer and their return to eMVee, the Customer will not be entitled to any refund of the Contract Price. Unless otherwise agreed between the Parties, eMVee will then return the Goods to the Customer and will be entitled to charge the Customer for eMVee's reasonable postage costs in returning them to the Customer by means of an appropriate mail service determined by eMVee.
Returns and refunds are not available for Goods that are specially made to the individual requirements of the Customer.
Gift Certificates
All Gift Certificates purchased via the eMVee site are subject to the following Terms & Conditions
- A Gift Certificate is valid for 12 months from date of issue.
- A Gift Certificate will be issued in Australian dollars (AUD) and if purchased outside of Australia will be subject to the exchange rate at the time of purchase.
- A Gift Certificate will be subject to a minimum value of $50 (AUD) and a maximum value of $1000 (AUD) per purchase.
- A Gift Certificate may be redeemed against all products on the eMVee site excluding sale items.
- If a purchase is less than the value of the Gift Certificate, the remaining balance can be used against a subsequent purchase excluding sale items.
- If a purchase is more than the value of the Gift Certificate, the remaining balance must be paid via the payment method outlined, subject to validation and authorisation by PayPal.
- If a Gift Certificate purchase is returned, a credit will be issued which can then be redeemed against a subsequent order.
- A Virtual Gift Certificate will be emailed to the intended recipient once payment for the Gift Certificate has been approved. A receipt for the Gift Certificate purchased will be sent to the purchaser as confirmation of purchase.
- A Postal Gift Certificate will be posted to either the purchaser or the intended recipient once payment for the Gift Certificate has been approved. A receipt for the Gift Certificate purchased will be sent to the purchaser as confirmation of purchase
- eMVee is not responsible for the non delivery of a Virtual Gift Certificate in cases where the wrong email address has been supplied or the non delivery of a Postal Gift Certificate in cases where the wrong address has been supplied.
- eMVee is not responsible if a Gift Certificate is lost, stolen or destroyed or used without permission.
- eMVee reserves the right to cancel a Gift Certificate if it deems such action necessary.
- Postage/Shipping costs are applicable on purchases made with an eMVee Gift Certificate.
- eMVee Gift Certificates are not valid when purchasing sale items.
Privacy Policy
The privacy of eMVee's customers is important. All personal details provided by the customer to eMVee will remain with eMVee and, except to the extent necessary to complete the sale and deliver the Goods, those details will not be provided to third parties.
Notices Variations and Termination
Any notification to be given between the Parties under the contract may be sent by electronic mail. It will be treated as given on the day when the delivering Party sends it by email to the correct previously notified email address of the receiving Party.
The contract may only be varied by writing confirmed between the Parties.
If the Customer is in breach of these Terms and Conditions then eMVee may terminate the contract with immediate effect by giving written notice to the Customer.
The contract will be treated as made in Australia, it will be governed by Australian law and any legal claim arising from it may be made in the Courts of Australia.
Intellectual Property Rights
The use of the eMVee website does not give you rights to its content, trademarks, designs or any other intellectual property including software and all HTML and other code contained within the site ('IP'). Photographic rights and reproduction rights rest solely with eMVee. All such IP, including third party trademarks, designs and related intellectual property rights mentioned or displayed on the eMVee website are protected by National Intellectual Property Laws and International Treaty provisions. Any reproduction or redistribution of the IP is prohibited and may result in civil and criminal penalties.
